A BILL TO BE ENTITLED
AN ACT
relating to consideration of a person's eligibility for a tuition
and fee exemption for certain veterans or their family members in
determining whether to admit the person into a certificate or
degree program of a public institution of higher education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 54.203, Education Code, is amended by
adding Subsection (h) to read as follows:
(h) In determining whether to admit a person to any
certificate program or any baccalaureate, graduate, postgraduate,
or professional degree program, an institution of higher education
may not consider the fact that the person is eligible for an
exemption under this section.
SECTION 2. Subsection (h), Section 54.203, Education Code,
as added by this Act, applies beginning with admissions to a public
institution of higher education for the 2006 spring semester.
Admissions to a public institution of higher education before that
semester are covered by the law in effect before the effective date
of this Act, and the former law is continued in effect for that
purpose.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
