A JOINT RESOLUTION
proposing a constitutional amendment to allow state or local peace
officers, firefighters, and emergency service personnel to serve in
the legislature.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 40(d), Article XVI, Texas Constitution,
is amended to read as follows:
(d) No member of the Legislature of this State may hold any
other office or position of profit under this State, or the United
States, except:
(1) as a notary public if qualified by law; or
(2) as a peace officer, firefighter, or provider of
emergency medical services employed by this State or a political
subdivision of this State if the position held is not a public
office.
SECTION 2. This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 8, 2005.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment to allow persons
employed by the state or a political subdivision of the state as
peace officers, firefighters, or providers of emergency medical
services to serve in the legislature."
