Suspending limitations on conference committee
jurisdiction, S.B. No. 14 (Jackson/Smithee)

SENATE RESOLUTION
BE IT RESOLVED by the Senate of the State of Texas, 79th
Legislature, Regular Session, 2005, That Senate Rule 12.03 be
suspended in part as provided by Senate Rule 12.08 to enable the
conference committee appointed to resolve the differences on
Senate Bill 14 (rates for certain property and casualty
insurance) to consider and take action on the following matter:
Senate Rule 12.03(4) is suspended to permit the committee
to add the following SECTION to the bill:
SECTION 6. Subsection(d), Article 5.43, Insurance Code,
is amended to read as follows:
(d) This article applies to an insurer that uses a tier
classification or discount program that has a premium
consequence based in whole or in part on claims experience
without regard to whether any of the policies that continuously
covered the policyholder, as described by Subsections (b)(1) and
(2) of this article, was a different type of residential property
insurance policy from the policy eligible for the discount.
Explanation: Amending Subsection (d), Article 5.43,
Insurance Code, is necessary to make certain that Subsection (d),
Article 5.43, Insurance Code, applies to insurers that use
certain types of tier classifications or discount programs.
