No fiscal implication to the State is anticipated.

The bill would amend Section 25.1042, Government Code, to authorize the Harrison County Court at Law to have original jurisdiction over cases alleging a violation of "Parent Contributing to Nonattendance" and "Failure to Attend School." The bill would amend the Education Code and the Family Code to add a statutory county court of the county in which the parent resides or in which the school is located, if the statutory county court has jurisdiction over the proceeding, to those courts in which a truancy case may be prosecuted.

The bill would also amend Section 71.0352, Government Code, to require a county court to include in its monthly report submitted to the Office of Court Administration the number of cases filed for failure to attend school and for parent contributing to nonattendance.

The bill would take effect September 1, 2005 and would apply only to an offense committed on or after that date.
