HB65 by McClendon (Relating to establishing a pilot program for Bexar County for the designation and enforcement of drug-free zones; providing penalties.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would require Bexar County to establish a pilot program on drug-free zones, with the district courts of that county responsible for implementation. Specific operations and enforcement related to the program are identified in the bill, including authorizing the attorney general, district attorney, county attorney, city attorney, or a Bexar County resident to sue to enjoin a public nuisance under the proposed new subchapter of Chapter 125, Civil Practice and Remedies Code. An offense for a violation of a court order under the pilot program would be a Class A misdemeanor.

It is assumed that responsibilities within the pilot program that are related to the state could be absorbed using existing resources.


Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
