LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

February 17, 2005

TO:
Honorable Carlos Uresti, Chair, House Committee on Government Reform

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB81 by Riddle (Relating to release by the comptroller of unclaimed property subject to a child support lien.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 74.501, Property Code, by amending Subsection (e) and adding Subsection (f) which would allow the Comptroller to approve an unclaimed property claim to the holder of a lien for child support owed against the reported owner of the unclaimed property. The Comptroller may also approve an unclaimed property claim to the Attorney General on behalf of the lien holder. Payment may not exceed the amount of arrearages owed to the lien holder. The amount of additional claims submitted to the Comptroller should not be significant and would be able to be absorbed into current appropriations.

Local Government Impact

No fiscal implication to units of local government is anticipated.
