LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 11, 2005

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB83 by Riddle (Relating to the eligibility of certain criminal defendants for release on community supervision.), As Introduced

No significant fiscal implication to the State is anticipated.

This bill would amend Article 42.12 of the Code of Criminal Procedure to treat a juvenile court felony adjudication that resulted in a youth’s commitment to the Texas Youth Commission in the same manner as an adult criminal court felony conviction for purposes of making a person ineligible for jury recommended community supervision. An increase in the adult incarceration population may result from offenders who might otherwise have been eligible for jury recommended community supervision; however, the increase in population is not anticipated to be significant.

The bill would take effect on September 1, 2005, and applies only to an offense committed on or after that date.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
