LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

February 11, 2005

TO:
Honorable Dianne White Delisi, Chair, House Committee on Public Health

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB102 by Van Arsdale (Relating to the renewal requirements for a respiratory care practitioner certificate.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Section 604.151 to require a respiratory care practioner certificate to be renewed on a biennial basis, eliminating the option to require annual renewal.  Current Department of State Health Services rules require biennial renewal. The bill would amend Section 604.154 to require continuing education hours to be earned annually, instead of during each renewal period.

Based on the analysis of the Department of State Health Services, the provisions of the bill would have no fiscal impact to the state.

The bill would take effect immediately upon enactment if it receives a two-thirds majority vote in both houses of the Legislature, otherwise it would take effect on September 1, 2005.

Local Government Impact

No fiscal implication to units of local government is anticipated.
