LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 2, 2005

TO:
Honorable David Swinford, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB145 by Farrar (Relating to an abortion when a fetal abnormality is detected.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would allow a person to obtain voluntary and informed consent to perform an abortion without complying with the requirements of Subchapter B of Chapter 171, Health and Safety Code, if a severe and irreversible abnormality is detected in the fetus.

The Department of State Health Services and the Office of the Attorney General assume that existing staff could meet the requirements of this bill.  The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house.  If the bill does not receive the vote necessary for immediate effect, the bill takes effect September 1, 2005.

Local Government Impact

No fiscal implication to units of local government is anticipated.
