The bill would allow a person to obtain voluntary and informed consent to perform an abortion without complying with the requirements of Subchapter B of Chapter 171, Health and Safety Code, if the pregnancy is the result of incest or sexual assault.
The Department of State Health Services assumes that existing staff will revise the licensing rules to include this amendment. The Office of the Attorney General does not anticipate any additional work as the result of this bill.
The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house. If the bill does not receive the vote necessary for immediate effect, the bill takes effect September 1, 2005.
