FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 3, 2005

TO:
Honorable Robert Talton, Chair, House Committee on Urban Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB148 by Harper-Brown (relating to the probationary period of persons appointed to beginning positions in certain fire or police departments. ), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to authorize the civil service commission to by rule extend the probationary period by not longer than six months of a person who must attend a basic training academy necessary for initial certification as a firefighter or police officer. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005. The provisions of the bill would apply only to persons employed as a firefighter or police officer on or after the effective date.

Under current statute, the minimum required probationary period is one year.

Local Government Impact

No fiscal implication to units of local government is anticipated.
