IN RE:
HB160 by McCall (Relating to motor vehicles equipped with recording devices.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require a person who sells or leases a new motor vehicle equipped with a recording device to disclose that information to the buyer or lessee of the vehicle.  It further states that any information recorded or transmitted by the recording device may not be retrieved by a law enforcement officer or a prosecutor unless a court order or subpoena is obtained showing that the retrieval of information is necessary to protect public safety or that the information constitutes evidence of an offense.

The Department of Public Safety indicates that the requirements of the bill can be achieved within existing resources.

The bill would take effect September 1, 2005.
