No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code as it relates to the prosecution of offenses involving the use of safety belts and child passenger safety seat systems.

The bill would make it an offense for a person to operate a passenger vehicle and transport a child younger than 6 years old or who is less than 51 inches in height and less than 80 pounds without the child being secured in a child passenger safety seat system according to the manufacturer's instructions.  The bill would also make it an offense for a person to transport a child older than six but younger than 17 and who is at least 51 inches in height or 80 pounds or more that is not secured by a safety belt, provided the child is occupying a seat that is equipped with a safety belt. 

The bill would take effect September 1, 2005.
