LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION
Revision 1

February 14, 2005

TO:
Honorable Will Hartnett, Chair, House Committee on Judiciary

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB230 by Hartnett (Relating to grounds for removal of a guardian.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Probate Code 761(a)(7) and 761(c)(6) by adding “or neglects” to both sections. This amendment would allow the court to remove, on its own motion or on motion of any interested person, the guardian when the guardian neglects the ward. The court already has this authority when the “guardian cruelly treats” the ward.

Local Government Impact

No fiscal implication to units of local government is anticipated.
