No significant fiscal implication to the State is anticipated.
The bill would amend the Transportation Code to make it an offense to use a telephone while operating a motor vehicle within a school crossing zone unless the vehicle is stopped. The bill would exempt emergency calls and operators of emergency vehicles. The offense would be a misdemeanor with a minimum fine of $125 and a maximum fine of $200. The bill would require municipalities and counties to remit, at the end of their fiscal year, 50 percent of the fines collected for violations to the Comptroller to be deposited into the Foundation School Fund. The bill would take effect September 1, 2005.
