No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code as it relates to the wearing of protective headgear by certain motorcycle operators and passengers.

 

Section 1 of the bill would amend the Transportation Code to require protective headgear be worn by anyone under the age of 21 who operates or rides as a passenger on a motorcycle. The bill would also amend the Transportation Code to make it an offense to transport a passenger under the age of 21 via motorcycle who is not wearing protective headgear that meets safety standards adopted by the Department of Public Safety. An offense committed under this section of the Transportation Code is a misdemeanor punishable by a fine of not less than $10 or more than $50.

 

The bill would take effect on September 1, 2005 and apply only to an offense committed on or after this date.
