No significant fiscal implication to the State is anticipated.
The bill would amend the Transportation Code as it relates to the wearing of protective headgear by certain motorcycle operators and passengers.
Section 1 of the bill would amend the Transportation Code to require protective headgear to be worn by anyone under the age of 21 who operates or rides as a passenger on a motorcycle. The bill would also amend the Transportation Code to make it an offense to transport a passenger under the age of 21 who is not wearing protective headgear that meets safety standards adopted by the Department of Public Safety. An offense committed under this section of the Transportation Code would be a misdemeanor punishable by a fine of not less than $10 or more than $50.
The bill would take effect immediately if a two-thirds majority vote in both houses of the Legislature is received. Otherwise, the bill would take effect on September 1, 2005.
