HB265 by Smith, Wayne (Relating to the time for processing a municipal building permit. ), Conference Committee Report

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to set deadlines for a municipality to grant or deny a permit to erect or improve a building or other structure in the municipality or its extraterritorial jurisdiction. The bill would also set deadlines for notifying permit applicants if the municipality cannot meet the deadlines for granting or denying the permit. If a municipality were to miss deadlines, it would not be able to collect permit fees associated with the application and would be required to refund any fees previously collected regarding the application.

The bill would go into effect September 1, 2005 and would apply only to applications filed on or after that date.
