LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

February 20, 2005

TO:
Honorable Mike Krusee, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB267 by Smith, Wayne (Relating to permits for access driveways to certain highways.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require the Texas Department of Transportation to either disapprove or approve a permit to construct an access driveway to certain highways within 42 days of receiving a completed application, or the permit would be automatically approved.  Based on the analysis of the Texas Department of Transportation, it is assumed that the provisions of the bill could be implemented within existing resources.

The bill would take effect September 1, 2005, and would only apply to an application for an access driveway permit received by the Texas Department of Transportation on or after that date.

Local Government Impact

No fiscal implication to units of local government is anticipated.
