No significant fiscal implication to the State is anticipated.

The bill would authorize a municipality with a population of more than 1.5 million and that has not adopted a comprehensive zoning ordinance under Subchapter A, Chapter 211, Local Government Code to adopt regulations limiting the number of wine and beer retailers that may operate in a zip code area wholly or partly within that area. The bill would take effect immediately if it receives the required two-thirds vote in both houses; otherwise, it would take effect September 1, 2005.

The city of Houston is the only municipality with a population of more than 1.5 million, based on the 2000 census.


Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
