LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 3, 2005

TO:
Honorable Tom Craddick, Speaker of the House, House of Representatives

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB364 by Hegar (Relating to the use, sale, purchase, or possession of a traffic-control signal preemption device; providing criminal penalties.), As Passed 2nd House

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code as it relates to the use, sale, purchase, or possession of a traffic-control signal preemption device and provides criminal penalties.  The bill would take effect immediately upon receiving a two-thirds majority vote in both houses; otherwise, the bill would take effect September 1, 2005.

Both the Department of Public Safety and the Department of Transportation report that the work resulting from the passage of the bill could be reasonably absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
