HB369 by Farabee (Relating to the civil and criminal consequences of racing a motor vehicle on a public highway in this state.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code by repealing Section 545.420, which prohibits racing on a highway. The bill would also amend the Penal Code by adding section 42.04, which creates the offense of and provides a penalty for racing on a public highway. The offense in the repealed section is essentially the same as the offense in the section added to the Penal Code.

The bill would take effect on September 1, 2005, and applies only to offenses committed on or after that date. Any offenses committed before September 1, 2005, would be covered by the law in effect when the offense was committed, and the former law is continued in effect for that purpose.
