No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to provide the courts an additional method to submit an expunction or nondisclosure petition to the Crime Records Service of the Department of Public Safety. The Department of Public Safety reports that the Crime Records Service would need to create a "secure" electronic mail account to receive these orders and create administrative rules to notify all parties of the electronic mail address and fax number for these communications, however; this could be accomplished within existing resources. The bill would take effect September 1, 2005.
Local Government Impact
No significant fiscal implication to units of local government is anticipated. Local governmental entities that choose the option of secure electronic mail or facsimile transmission to send and receive certified orders of expunction would see some costs to implement these features, but these costs are not expected to be significant.
