LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

February 16, 2005

TO:
Honorable David Swinford, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB457 by Dutton (Relating to access to certain law enforcement and prosecutorial records under the public information law.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would remove from exception under the public information law certain law enforcement and prosecutorial records. The bill would take effect September 1, 2005.

The Office of Attorney General indicates that if there is any increase in workload as a result of enactment of the bill, it could be absorbed using existing resources. The same is anticipated concerning law enforcement records kept by the Department of Public Safety. Responses from a sampling of local government entities contacted indicated that costs associated with implementing provisions of the bill could be absorbed using existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
