No fiscal implication to the State is anticipated.
The bill would prohibit school districts from administering an assessment instrument, test, or survey or presenting curriculum to a student that reveals private information about the student or the student’s family unless the district provides advance notification to the student’s parent and obtains written consent of the parent. The bill would also require a parent’s written and informed consent prior to providing any psychological services to a child, including progressive relaxation techniques.
The bill would take effect September 1, 2005 or immediately upon passage by the necessary majorities and would apply beginning with the 2005-06 school year.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
To the extent that a school district could satisfy the notification requirement via materials sent home with the child and receive written consent by the same method, the vast majority of districts would not incur significant additional costs to meet the requirements of the bill.
