LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 9, 2005

TO:
Honorable Robert Talton, Chair, House Committee on Urban Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB538 by Bohac (Relating to the construction or operation of chemical dependency treatment facilities near certain residential and community properties in certain municipalities. ), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would apply to property located in a municipality with a population of more than 1.5 million. According to the 2000 federal census, the City of Houston is the only municipality that meets that criteria.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
