HB550 by Phillips (Relating to the preparation of and procedures related to a presentence report in a felony case.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would amend Article 42.12, Code of Criminal Procedure, to establish that unless waived by a defendant, at least 48 hours before sentencing, the judge shall permit the defendant or the defendant's counsel to read the presentence report. The bill would also stipulate that a judge would not be required to order that a presentence report be prepared.

The bill would take effect September 1, 2005.
