No fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure by removing the option for a defendant to request that the judge require preparation of a presentence report in certain circumstances in which the judge otherwise is not required to have a report prepared. The bill would take effect September 1, 2005.

Under current statute, if a defendant requests a presentence report when a report is not otherwise required, the judge must order the report be prepared. There would be a savings associated with any reduction in the number of reports prepared, but the amount is anticipated to be insignificant.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
