No fiscal implication to the State is anticipated.

The bill would change the procedures for incorporating an area in the extraterritorial jurisdiction or the limited purpose annexation area of certain municipalities. Included in the procedures would be a requirement that the county judge to whom the residents must file a petition for incorporation order an incorporation election to be held as per current statute. The bill would take effect immediately if it receives two-thirds vote in both houses; otherwise, it would take effect September 1, 2005.


Local Government Impact

Based on data reported to the Secretary of State in March 2004, the average cost of an election for a local government entity is $1.29 per registered voter, although the cost is higher if an election is held on a uniform election date other than the general election. Costs would vary by local government.

No significant fiscal implication to units of local government is anticipated.
