No fiscal implication to the State is anticipated.

The bill would change the procedures for incorporating an area in the extraterritorial jurisdiction of certain municipalities. Included in the procedures would be a requirement that the county judge to whom the residents must file a petition for incorporation order an incorporation election to be held as per current statute. The bill would take effect immediately if it receives two-thirds vote in both houses; otherwise, it would take effect September 1, 2005.

Based on data reported to the Secretary of State in March 2004, the average cost of an election for a local government entity is $1.29 per registered voter.
