The bill would change the procedures for incorporating an area in the extraterritorial jurisdiction or the limited purpose annexation area of certain municipalities. Included in the procedures would be a requirement that the county judge to whom the residents must file a petition for incorporation order an incorporation election to be held as per current statute. The bill would also establish criteria and limitations related to incorporation by a deferred annexation area.
The bill would take effect immediately if it receives two-thirds vote in both houses; otherwise, it would take effect September 1, 2005.
Based on data reported to the Secretary of State in March 2004, the average cost of an election for a local government entity is $1.29 per registered voter, although the cost is higher if an election is held on a uniform election date other than the general election. Costs would vary by local government.
No significant fiscal implication to units of local government is anticipated.Source Agencies: |
