April 11, 2005

TO:
Honorable Kent Grusendorf, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB625 by Olivo (Relating to the discipline of public school students who voluntarily surrender prohibited items.), As Introduced

No significant fiscal implication to the State is anticipated.

Section 1 of the bill would require that a school district’s student code of conduct provide guidelines under which a student who unknowingly brings a prohibited item to school can avoid disciplinary action by turning the item in to school officials with written notice provided to the student’s parent.

Sections 2 and 3 of the bill would revise language relating to offenses involving firearms and other weapons to trigger action.  It is assumed that the provisions in the bill could affect the number of students expelled.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.  It is assumed that the bill could affect the number of students expelled and district disciplinary action in certain situations.
