No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 409, Property Code, by adding Section 409.004 and amending 416.002(b).  Registered builders and builder registration applicants would be required to disclose to the Texas Residential Construction Commission (TRCC) each conviction, plea of guilty or nolo contendere to a felony charge or to a misdemeanor and each judgment against the builder in a dispute involving a construction defect or other transaction between the builder and a homeowner.  The TRCC would be required to post this information on its website and modify the builder registration application form to accommodate the required information.

Based on the analysis of TRCC the costs and duties associated with implementing the provisions of the bill could be absorbed within existing resources.

The bill would take effect immediately upon receiving a two-thirds majority vote in each house.  If the bill does not receive a two-thirds majority vote in each house, the bill would take effect September 1, 2005.
