The bill would amend Subchapter B, Chapter 247, Health and Safety Code by adding Section 247.032. Provisions of the bill would require the Commissioner of the Department of Aging and Disability Services (DADS) to appoint a workgroup study the feasibility of requiring facilities that furnish food and shelter to three or fewer individuals unrelated to the proprietor of the facility to register with the DADS and the best method to identify those facilities.
The Act requires that the workgroup be appointed no later than January 1, 2006 and must include: representatives of DADS, a representative from the Department of Family and Protective Services, a resident of an assisted living facility, a representative of licensed assisted living facility, an advocate for persons with disabilities, an advocate for the elderly, representatives of provider associations representing assisted living facilities, and representatives of local government entities, both urban and rural. The workgroup would be required to submit findings to the lieutenant governor, speaker, and the presiding officers of the standing committees of each house with jurisdictions over assisted living facilities no later than January 1,2007.
