LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 25, 2005

TO:
Honorable David Swinford, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB702 by Zedler (Relating to a physician's report of a complication resulting from an elective termination or attempted elective termination of pregnancy.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would require physicians to file a report with the Department of State Health Services (DSHS) when medical care or treatment is given to a woman that they determine has complications resulting from an abortion or attempted abortion.  The bill would require DSHS to maintain a toll-free telephone number for a physician to use to submit the requested report.

The Department of State Health Services indicates that an existing toll-free number will be used, and existing staff will receive the complaints and coordinate with the Texas Board of Medical Examiners to notify physicians of the requirement. The Board of Medical Examiners does not anticipate any fiscal impact from this bill.

The bill would take effect September 1, 2005, but only requires reporting of complications from abortion which occur after January 1, 2006.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
