LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 1, 2005

TO:
Honorable David Swinford, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB702 by Zedler (Relating to a physician's report of a complication resulting from an abortion; providing a penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require physicians to file a report with the Department of State Health Services when medical care or treatment is given to a woman that they determine has complications resulting from an abortion or attempted abortion.  The report must be submitted on a form prescribed by the department. Violation of the provision would be a Class A misdemeanor.

The Department of State Health Services indicates that existing staff will develop the form and coordinate with the Texas Board of Medical Examiners to notify physicians of the requirement. The Board of Medical Examiners does not anticipate any fiscal impact from this bill.

The bill would take effect September 1, 2005.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
