LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 29, 2005

TO:
Honorable Todd Staples, Chair, Senate Committee on Transportation & Homeland Security

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB749 by Jones, Delwin (Relating to size and weight limitations for certain vehicles transporting agricultural products and equipment.), Committee Report 2nd House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to exempt from the weight limitations established in Section 621.101, Transportation Code, all vehicles transporting chile pepper modules, seed cotton, or equipment used to transport or process chile pepper modules or seed cotton. The bill would require the Texas Department of Transportation (TxDOT) to issue specialty license plates for motor vehicles used exclusively for the transport of chile pepper modules or other equipment used to transport or process chile peppers.

Based on the analysis of TxDOT, it is assumed any costs and duties associated with implementing the provisions of the bill could be absorbed within existing resources.

The bill would take effect September 1, 2005.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
