LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 17, 2005

TO:
Honorable Tom Craddick, Speaker of the House, House of Representatives

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB769 by Smith, Wayne (Relating to the deadline for evaluating and ranking competitive sealed proposals for certain construction services submitted to a navigation district or port authority.), As Passed 2nd House

No fiscal implication to the State is anticipated.

The bill would authorize a navigation district or a port authority, if it demonstrates that 45 days is insufficient to complete a thorough evaluation of competitive sealed proposals for certain construction services to, not later than the 90th day after the date of opening the proposals, evaluate and rank each proposal.

The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005. The provisions of the bill would apply only to requests for proposals submitted on or after the effective date.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
