Honorable Robert Duncan, Chair, Senate Committee on State Affairs
FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board
IN RE:
HB831 by Gonzales (Relating to the eligibility of certain judges to retire with full benefits. ), Committee Report 2nd House, Substituted
No significant fiscal implication to the State is anticipated.
The bill would amend one retirement eligibility provision in the Judicial Retirement System Plan II (JRS II), allowing judges to retire after reaching age plus years of service equal to or exceed 70 if they have 12 years of service in an appellate court. Currently, the provision requires two full terms on an appellate court. Since a term is six years, this is not expected to have a material effect on JRS II. The bill would also apply a similar provision for JRS I members.
Local Government Impact
No fiscal implication to units of local government is anticipated.
