No fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure by adding an offense involving child pornography to the offenses for which items that were seized during the execution of a search warrant shall be ordered by the court to be destroyed or forfeited to the state upon conviction of a person for possession of the seized items. The bill would take effect September 1, 2005 and would apply to the disposition of obscene material or child pornography seized on or after that date.
