No fiscal implication to the State is anticipated.
The bill would amend Health and Safety Code, Section 242.042 (a) and add Section 242.0425. Section 242.042 (a) would require nursing facilities to post a notice on whether they are covered by professional health care liability insurance for a health care liability claim against the institution. Section 242.0425 would require nursing facilities to provide each resident and the resident's next of kin or guardian a written statement on whether they are covered by professional health care liability insurance. A copy of the statement would need to be signed by the resident or the resident's next of kin or guardian and kept in the facility's records for that resident.
