No fiscal implication to the State is anticipated.

The bill would add to the definition of "public nuisance," maintaining in a neighborhood in a county with a population of more than 1.4 million, a swimming pool that is not protected as required by statute. The bill would specify certain protections that would be required. The bill would take effect September 1, 2005. A person would not be required to comply with the provisions of the bill before January 1, 2006.

The population restriction would apply to Dallas, Tarrant, and Harris counties. It is anticipated that costs for enforcement of an additional public nuisance requirement would be insignificant.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
