No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to prohibit state law from regulating the provision of samples of produce to consumers at a municipally owned farmers' market. The bill would also exempt samples of produce at a municipally owned farmers' market from regulations by a county or public health district.

The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.
