No fiscal implication to the State is anticipated.

The bill would authorize a county commissioners court to designate an area other than the courthouse, but in a public place within a reasonable proximity of the county courthouse, where a sale of real property under a contract lien would be held. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.

Under current statute, such sales are required to be held at the county courthouse. The fiscal impact of administrative functions associated with conducting a sale at another location is anticipated to be insignificant.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
