TO: | Honorable Ray Allen, Chair, House Committee on County Affairs |
FROM: | John S. O'Brien, Deputy Director, Legislative Budget Board |
IN RE: | HB961 by Smith, Wayne (Relating to the location of a sale of real property under a contract lien.), As Introduced |
The bill would authorize a county commissioners court to designate an area other than the courthouse where a sale of real property under a contract lien would be held. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.
Under current statute, such sales are required to be held at the county courthouse. The fiscal impact of administrative functions associated with conducting a sale at another location is anticipated to be insignificant.
