May 28, 2005

TO:
Honorable David Dewhurst , Lieutenant Governor, Senate
Honorable Tom Craddick, Speaker of the House, House of Representatives

FROM:

IN RE:
HB969 by Keel (Relating to court orders for discovery in a criminal case and to certain time limits on and the consequences of a delay in the prosecution of a criminal case.), Conference Committee Report

No significant fiscal implication to the State is anticipated.

The bill would amend Article 39.14(a), Code of Criminal Procedure, which would require courts to permit the inspection of documents and other specified items in the possession of the State in a criminal case upon motion of the defendant. Current law allows, but does not require, courts to permit such inspection.

The bill would repeal Article 32A.02, Code of Criminal Procedure, which establishes time limitations related to dismissing prosecutions.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
