LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 18, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1079 by West, George "Buddy" (Relating to the eligibility of certain judges to retire with full benefits.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would allow judges in the Judicial Retirement System Plan II (JRS II) who are appellate judges to retire after serving all or part of at least three terms if their age plus service equals at least 70; currently they need to have served two full terms. The bill would also allow judges in the Judicial Retirement System Plan I (JRS I) who are appellate judges to retire after serving two full terms if their age plus service equals at least 70. Neither provision is judged by the JRS plans' actuary to have a material effect on the long-term costs or actuarial soundness of the systems.

The bill would take effect September 1, 2005.

Local Government Impact

No fiscal implication to units of local government is anticipated.
