No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code related to when a court shall suspend execution of sentence for a minor convicted of a tobacco offense. The bill would take effect September 1, 2005 and would apply only to an offense committed on or after that date.

Under current statute, the court is required to suspend the sentence on conviction of a minor for a tobacco offense. The proposed statute would add payment of court costs as a precursor to suspending the sentence.

No significant fiscal implication to units of local government is anticipated.
