No fiscal implication to the State is anticipated.
The bill would require a court to impose a fee sufficient to cover expungement costs to file an application to have a minor's alcohol-related or tobacco-related conviction record expunged. The bill would take effect September 1, 2005 and would apply only to an application for expungement filed in a court on or after that date.
Local Government Impact
Imposition of a fee to expunge a record would generate revenue to cover the cost of processing the request. Under current statute, the court absorbs the costs associated with an expungement; therefore, provisions of the bill would result ultimately in a savings to the courts. The fiscal impact would vary by court, depending on the number of applications for expungement filed annually, although the positive fiscal impact is expected to be insignificant.
