HB1140 by Flynn (Relating to the specifications and fees for legal papers filed with a county clerk.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to prohibit a county clerk from imposing requirements or fees for filing or recording a legal paper other than those requirements and fees specified in statute. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.

Current statute does not specify whether a county clerk may or may not impose requirements and fees in addition to those outlined in statute.


Local Government Impact

If a county clerk is currently imposing additional requirements or fees, discontinuing additional fees would result in a reduction in revenue. Discontinuing additional requirements may result in an increase in administrative costs. For county clerks that do not impose additional requirements or fees, enactment of the bill would have no fiscal impact.

No significant fiscal implication to units of local government is anticipated.
